Burgess Genealogy -1865 ed" says 1719.
Jacob Burgess the third son of Thomas,helped to repair the meeting-house
in 1644, and was early a member of thechurch. He served the town for
many years in the subordinate offices ofsurveyor, constable and grand
juror. He took the oath of allegiancein 1657. He inherited, in behalf
of his son Thomas, the paternal estatein Sandwich, while the other
brothers removed, Thomas to Newport, Johnto Yarmouth, and Joseph to
Rochester. He was one of the Executors ofhis Father's will. He married
Mary, daughter of Benjamin Nye, June 1,1670, who died June 23, 1706. He

Freeman's History of Cape Cod contains someinteresting gossip concerning
Jacob and his father-in-law Benjamin Nye.The information is based upon
old town records. A member of thecommunity was accused of uttering some
heresy with respect to the Deity.....Mr Nye wished to foster popular
credence in the accusation, so he triedto induce Jacob Burgess to bear
witness in support of the charge. Atthat time Jacob was seeking the
hand of Benjamin Nye's daughter, Mary,in matrimony, and Mr. Nye
threatened paternal disapproval if Jacobdid not accede to his request.
The outcome is not stated, further thanthat the marriage took place.,
"Many of the early settlers who camefrom England had a keen
interest in preserving genealogicalrecords. Some of these old records
are used in the "Genealogy of the NyeFamily" to trace the Nye family ,
of whom Mrs. Burgess was a member, back toLave Nye, a descendant of the
Royal House of Sweden, of the earlyfourteenth century. From this same
source the Burgesses for whom this book iscompiled can therefore trace a linage."
